The debate over U.S. cryptocurrency regulation is once again heating up as Senator John Kennedy (R-LA) openly questioned Senate Banking Committee Chair Tim Scott’s September 30 deadline for advancing comprehensive crypto market structure legislation.

While lawmakers continue to debate the future of digital assets, industry experts warn that deep uncertainty over regulatory frameworks and institutional preparedness could stall progress, even as lobbying efforts intensify and the crypto industry demands clarity.

Kennedy Voices Concerns Over Readiness

Speaking with reporters on Wednesday, Kennedy made it clear that the Senate Banking Committee is far from consensus on a sweeping market structure bill. His comments suggest that momentum may be slowing despite growing pressure to finalize legislation before year-end.

“I don’t think we’re ready,” Kennedy told reporters, according to a POLITICO report. “People that I talk to still have a lot of questions. I know I still have a lot of questions.”

Kennedy’s hesitation casts doubt on the Senate’s ability to deliver a comprehensive counterpart to the House-passed CLARITY Act, which laid out initial regulatory boundaries for digital assets.

From Stablecoins to Market Structure: A Leap Forward

The latest push comes just months after Congress passed the GENIUS Act in July, which introduced federal standards for dollar-pegged stablecoins. While that legislation was hailed as a milestone, Kennedy dismissed it as incremental progress.

“As important as the GENIUS Act was, it was a baby step,” Kennedy said. “This is a full leap. And we’ve got to get it right.”

Industry analysts agree that the stablecoin bill was highly targeted—focused only on one asset class—whereas the proposed market structure framework would set rules across the entire digital asset ecosystem, impacting exchanges, decentralized finance (DeFi) platforms, custody providers, and institutional investors.

Why Banks Are Hesitant on Digital Assets

The biggest challenge to swift progress lies in the financial sector’s readiness to embrace crypto. Traditional banks, which remain central to the U.S. financial system, are not yet prepared for rapid changes in market structure.

Nitesh Mishra, co-founder and CTO at hedging platform ChaiDEX, told Decrypt that institutional hesitation stems from multiple structural gaps:

  • Risk management deficiencies – Traditional banks lack robust frameworks for handling volatile crypto assets.

  • Compliance concerns – Meeting anti-money laundering (AML) and know-your-customer (KYC) standards in the crypto space remains complicated.

  • Technology gaps – Legacy systems are poorly equipped to integrate with blockchain networks.

“Central banks often act as brakes,” Mishra said, noting that regulators prioritize consumer protection and tend to limit direct engagement with crypto markets.

He cautioned that rushing sweeping reforms without addressing these gaps “will remain unrealistic and potentially risky for broader financial stability.”

Crypto Industry Lobbying Intensifies

The uncertainty in Congress hasn’t stopped the crypto industry from doubling down on its Washington lobbying efforts. Clear federal rules are viewed as essential for survival, especially under the Trump administration’s more favorable stance toward blockchain innovation.

For exchanges, DeFi projects, and stablecoin issuers, the market structure bill represents a chance to finally operate with a defined legal framework. The lack of clarity has driven companies to set up offshore entities or face regulatory disputes with the Securities and Exchange Commission (SEC).

Yet, the House-passed CLARITY Act drew criticism from DeFi advocates, who argued that it imposed centralized exchange-like restrictions on decentralized protocols. Critics claim such provisions could undermine decentralization by forcing projects into compliance models they were never designed for.

Political Divide: Fewer Democrats Backing Market Structure Bill

US Senate Draft Bill Eases Crypto Regulations

Senate Banking Chair Tim Scott, the Republican leading the legislative push, has acknowledged that Democratic support is weaker compared to earlier efforts.

In August, Scott estimated that “between 12 and 18 Democrats” may support the bill—fewer than the 18 Democrats who backed the GENIUS Act.

With Republicans holding a 53-seat majority, Scott needs at least seven Democratic votes to secure passage. But Kennedy’s public doubts suggest that even Republican unity is not guaranteed, potentially complicating the path forward.

What’s at Stake for the U.S. Crypto Industry

The outcome of the Senate debate could have sweeping consequences for the future of crypto in America. Key issues under discussion include:

  • Jurisdictional clarity – Determining whether the SEC or the Commodity Futures Trading Commission (CFTC) will have primary oversight of crypto assets.

  • Consumer protection – Establishing safeguards against fraud, hacks, and market manipulation.

  • Stablecoin oversight – Building on the GENIUS Act to ensure dollar-backed digital currencies remain fully collateralized and transparent.

  • DeFi regulation – Balancing innovation with compliance requirements for decentralized protocols.

  • Institutional access – Creating pathways for banks and investment firms to safely enter the crypto space.

Without federal clarity, companies risk operating under a patchwork of state regulations while investors remain uncertain about the legality of key market practices.

Experts Warn Against Rushed Legislation

While many in the industry are eager for clarity, experts stress that rushed legislation could prove damaging.

Financial analyst Laura Chen of MarketBridge Advisors argues that the U.S. must strike a balance between innovation and stability:

“If the legislation is too restrictive, we risk driving innovation offshore. If it’s too permissive, we risk another 2008-style financial crisis—only this time triggered by digital assets.”

This tension highlights the difficulty of crafting a bill that satisfies lawmakers, regulators, banks, and crypto innovators simultaneously.

Global Implications of U.S. Crypto Regulation

The U.S. debate is also being closely watched abroad. Nations like Singapore, the UAE, and the UK have already advanced regulatory frameworks to attract blockchain startups.

If the U.S. lags, it risks ceding leadership in the global digital economy. A comprehensive market structure law could either:

  • Reaffirm U.S. dominance by setting international standards.

  • Or drive innovators overseas, where clearer and more favorable regulatory environments already exist.

The Road Ahead: September 30 and Beyond

With less than three weeks until the September 30 deadline, uncertainty looms over whether the Senate can deliver a workable framework.

Kennedy’s skepticism underscores the complexity of aligning political, regulatory, and industry priorities in a fast-evolving market.

If Congress delays again, the U.S. crypto sector may remain in a regulatory gray zone, stifling growth and leaving investors exposed to risks. On the other hand, moving too quickly could create unintended consequences that destabilize markets.

For now, all eyes are on Capitol Hill as lawmakers weigh whether the U.S. will take a decisive step toward crypto regulatory clarity or continue to kick the can down the road.
